About These Terms
Welcome to apt13books.com (the “Site”), operated by Apartment 13 Books (“Apt13 Books,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the Site and any services, content, features, or purchases made through the Site. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Site.

Eligibility & Accounts
Age: You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Site. If you are under the age of majority, you may use the Site only with the involvement of a parent or legal guardian.
Account Registration: You may need an account to purchase or access certain features. You must provide accurate information and keep it updated. You are responsible for all activity under your account and for safeguarding your credentials.
Not for Resale: Unless expressly authorized in writing, purchases are for personal use only and not for resale or distribution.
Purchases, Payments & Taxes
Direct Sales: We sell books and related merchandise directly on the Site. Prices, availability, and promotions are subject to change without notice. We may limit or cancel orders at our discretion.
Payment Processing: Payments are processed by third‑party providers. We do not store full payment card details. Your use of payment services is subject to the provider’s terms and privacy policy. Payment processors typically cost the store roughly 3% of every transaction. You should not be charged any transaction fees from our payment processors. Your final checkout should include: the cost of the book or books you intend to buy, shipping (only in the case that shipping is not listed as included in the book price), and taxes. The store pays the cost of the payment processing transactions.
Shipping, Risk of Loss & Title: Title and risk of loss transfer to you upon our delivery of items to the carrier. Delivery dates are estimates and not guaranteed.
Taxes & Duties: You are responsible for all applicable taxes, duties, and import fees.
No Unlawful Use: You agree not to purchase with fraudulent or unauthorized payment methods.
eBay Listings
We may also sell titles or merchandise through eBay. Those purchases are governed by the applicable eBay listing terms and eBay’s user agreement in addition to these Terms. In case of conflict for an eBay purchase, the eBay listing terms and eBay’s policies will control for that transaction.
Returns, Refunds & Cancellations
Our Returns/Refunds policy is posted on the Site (or shown at checkout) and incorporated by reference. If not posted, returns are accepted only as required by law or under any written guarantee we expressly provide. Digital goods, downloads, and signed/personalized items are typically final sale unless defective. To initiate a return or inquire about order issues, contact apartment13retail@gmail.com with your order number.
Intellectual Property & License to You
Our IP: The Site, including all text, images, graphics, logos, trademarks, service marks, audio, video, code, and design, is owned by or licensed to Apt13 Books and protected by intellectual property laws.
Limited License: We grant you a limited, nonexclusive, nontransferable, revocable license to access and use the Site for personal, noncommercial use, strictly as permitted by these Terms.
Restrictions: You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Site or its content except as expressly permitted by law.
User Content (Reviews, Comments, Submissions)
Your Responsibility: If you post reviews, comments, or other content (“User Content”), you must ensure it is lawful, accurate, not misleading, and does not infringe any rights.
License to Use: You grant Apt13 Books a worldwide, royalty‑free, sublicensable, transferable license to use, reproduce, modify, publish, translate, distribute, and display your User Content in connection with the Site and our business, in any media now known or later developed, with the exception of any personal information used in purchasing transactions through the Site.
Consumer Protection Rights: Information used to make a purchase with Apt13 Books is protected by consumer protection laws and will not be reproduced without an express, written request of the customer it belongs to, or a valid court order with all relevant notice being provided to the customer whose information is at issue.
Moderation: We may (but have no obligation to) monitor, edit, or remove User Content at our discretion.

Our aggregate liability for any claim will not exceed the amount you paid to us for the product(s) giving rise to the claim during the twelve (12) months preceding the event.

Indemnification

DMCA / Copyright Complaints

Governing Law; Venue (U.S.)
These Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the State of Maryland, without regard to conflict‑of‑law rules. Subject to the Arbitration section below, the exclusive venue for any permitted court action will be the state or federal courts located in Baltimore County, Maryland, and you consent to personal jurisdiction there.
Binding Arbitration; Class Action Waiver (U.S.)

Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding arbitration administered by either AAA or JAMS under its applicable rules.
Venue & Law: The seat of arbitration will be Baltimore County, Maryland (or your county of residence, at your election). Maryland law will apply to the extent not preempted by the Federal Arbitration Act.
Individual Basis Only: No class, collective, consolidated, or representative actions or arbitrations are permitted. The arbitrator may award relief only to the individual party seeking relief.
Small Claims Carve‑Out: Either party may bring an individual action in small claims court if eligible.
Opt‑Out: You may opt out of this arbitration provision by sending written notice to apartment13retail@gmail.com within 30 days after you first accept these Terms. Your opt‑out will not affect your use of the Site.
If any part of this Section is found unenforceable, the remainder will remain in effect; if the class waiver is found unenforceable, the entire arbitration provision will be void.
State‑Specific Terms (U.S.)
California (CPRA): See our Privacy Policy for your rights to know/access, delete, correct, and opt out of “sale” or “sharing” for cross‑context behavioral advertising. We honor Global Privacy Control (GPC) where required.

Auto‑Renewals (if applicable): If we offer subscriptions or auto‑renewing services, the terms, pricing, renewal cadence, and cancellation method will be clearly disclosed before purchase, and required renewal reminders will be provided in jurisdictions that mandate them.

If you access the Site from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws.
